Obama blocks Chinese purchase of US wind farms

(AP) ? Citing national security risks, President Barack Obama on Friday blocked a Chinese company from owning four wind farm projects in northern Oregon near a Navy base where the U.S. military flies unmanned drones and electronic-warfare planes on training missions.

It was the first time in 22 years that a U.S. president has blocked such a foreign business deal.

Obama's decision was likely to be another irritant in the increasingly tense economic relationship between the U.S. and China. It also comes against an election-year backdrop of intense criticism from Republican presidential challenger Mitt Romney, who accuses Obama of not being tough enough with China.

In his decision, Obama ordered Ralls Corp., a company owned by Chinese nationals, to divest its interest in the wind farms it purchased earlier this year near the Naval Weapons Systems Training Facility in Boardman, Ore.

The case reached the president's desk after the Committee on Foreign Investments in the United States, known as CFIUS, determined there was no way to address the national security risks posed by the Chinese company's purchases. Only the president has final authority to prohibit a transaction.

The administration would not say what risks the wind farm purchases presented. The Treasury Department said CFIUS made its recommendation to Obama after receiving an analysis of the potential threats from the Office of the Director of National Intelligence.

Morrow County planner, Carla McLane, said the projects had won county approval and construction was under way until CFIUS issued an order in July that halted construction. She said she does not know what the security concerns were.

Each of the four projects consists of five turbines, each with a two-megawatt capacity, for a total of 10 megawatts per project, or a total of 40 for the four. As the crow flies, McLane said, the projects are about 10 miles from the bombing range ? as it's known locally.

The military has acknowledged that it used the Oregon Naval facility to test unmanned drones and the EA-18G "Growler." The electronic warfare aircraft accompanies U.S. fighter bombers on missions and protectively jams enemy radar, destroying them with missiles along the way.

At the Oregon site, the planes fly as low as 200 feet and nearly 300 miles per hour.

The last time a president used the law to block a transaction was 1990, when President George H.W. Bush voided the sale of Mamco Manufacturing to a Chinese agency.

In 2006, President George W. Bush approved a CFIUS case involving the merger of Alcatel and Lucent Technologies.

The Treasury Department said in a statement that Obama's decision is specific to this transaction and does not set a precedent for other foreign direct investment in the U.S. by China or any other country.

China's trade advantage over the U.S. has emerged as a key issue in the final weeks of the presidential campaign. Romney accuses Obama of failing to stand up to Beijing, while the president criticizes the GOP nominee for investing part of his personal fortune in China and outsourcing jobs there while he ran the private equity firm Bain Capital.

Both campaigns are running ads on China in battleground states, especially Ohio, where workers in the manufacturing industry have been hard-hit by outsourcing.

Obama, in an interview Wednesday with The Plain Dealer of Cleveland, said the U.S. must push hard against Beijing but "not go out of our way to embarrass" China.

"We're not interested in triggering an all-out trade war that would damage both economies," Obama said.

The president has the power to void foreign transactions under the Defense Production Act. It authorizes the president to suspend or prohibit certain acquisitions of U.S. businesses if there is credible evidence that the foreign purchaser might take action that threatens to impair national security.

CFIUS is chaired by the treasury secretary. The secretaries of state, defense, commerce, energy and homeland security are also on the committee. The director of national intelligence is a non-voting member.

Earlier this month, Ralls sued the national security panel, alleging CFIUS exceeded its authority when it ordered the company to cease operations and withdraw from the wind-farm developments it bought. Ralls asked for a restraining order and a preliminary injunction to allow construction at the wind farms to continue. The firm said it would lose the chance for a $25 million investment tax if the farms were not operable by Dec. 31.

In a statement Friday, Tim Kia, a lawyer for Ralls, said the project posed no national security threat and said "the President's order is without justification, as scores of other wind turbines already operate in the area."

Ralls dropped its request for a preliminary injunction this week after CFIUS allowed the firm to resume some pre-construction work. With the lawsuit, continuing, the firm's lawyers were expected to react quickly to the administration decision, said a person familiar with the lawsuit who insisted on anonymity because of the sensitive legal repercussions.

Ralls' legal team includes Paul Clement and Viet Dinh, two top law veterans of President George W. Bush's administration. Both men were key players in Bush's aggressive national security operation.

Clement, who was solicitor-general and argued administration positions before the Supreme Court, has since opposed the Obama administration's health care plan and defended the Defense of Marriage Act before the top court.

Dinh, a former assistant attorney general who was the main architect of the Bush administration's anti-terror USA Patriot Act, has lately served as a director and legal adviser to Rupert Murdoch's News Corporation.

A second Chinese firm stymied by CFIUS urged U.S. authorizes this week to investigate their firm to quell fears of ties to China's military. Huawei Technologies Ltd. announced in early September that it would unwind its purchase of U.S.-based computer firm 3Leaf Systems after the deal was rejected by CFIUS.

Huawei, one of the world's largest producers of computer network switching gear, has repeatedly struggled to convince U.S. authorities that they can be trusted to oversee sensitive technology sometimes used in national security work. In 2008, CFIUS concerns led Huawei and private equity firm Bain Capital to abandon an $2.2 billion deal to buy a firm that produces anti-hacking software for the U.S. military

Ozone Media Launches Retargeting Service Smarton - MediaNama

Ozone Media, a?digital ad network, has?launched Ozone Smarton, a re-targeting and dynamic banner advertising platform. According to the company,?Ozone Smarton will allow e-commerce merchants to acquire dropped-off and dormant consumers by assembling dynamic banners in real-time and serving them to the re-targeted audience.

It mentioned that?Smarton is powered by predictive algorithms that determine the optimal product to be shown to the re-targeted users, and that it builds intelligence about users who have visited an advertiser?s website and shows them the relevant products in the retargeted dynamic banner ads. Ozone claims that on Smarton pushed up the conversion rate by three to eight times for the retargeted audience, in initial results.?After e-commerce, Ozone also intends to target the travel segment, followed by?other online verticals where online customer acquisition is important.

How Retargeting Works:?Drop-off visitors are users who visit the advertiser?s site, or a site which sells the advertiser?s products or just a site where the advertiser has advertised, but don?t take any action, and move to another site. For example, if a user visits an e-commerce site and searches for a particular product,but doesn?t make a purchase and switches to another site, the retargeting service will instantly generate banner ads, enabling the company to place them on sites which the user visits. It might even list the the product on top when a user searches for a mobile phone on a search engine and display a different landing page for the user to feature that product.

Although, dynamic retargeting is an effective strategy to attract and retain users but going on an overkill, might end up hurting companies and their brands, since people might find it irritating, and equate it to online stalking.

(AP) ? A Massachusetts chemist accused of faking drug test results, forging paperwork and mixing samples at a state police lab was arrested Friday in a scandal that has thrown thousands of criminal cases into doubt.

Annie Dookhan, 34, was led to a state police cruiser at her home in Franklin, about 40 miles southwest of Boston. Dookhan's alleged mishandling of drug samples prompted the shutdown of the Hinton State Laboratory Institute in Boston last month and resulted in the resignation of three officials, including the state's public health commissioner.

State police say Dookhan tested more than 60,000 drug samples involving 34,000 defendants during her nine years at the lab. Defense lawyers and prosecutors are scrambling to figure out how to deal with the fallout.

Since the lab closed, more than a dozen drug defendants are back on the street while their attorneys challenge the charges based on Dookhan's misconduct.

Many more defendants are expected to be released. Authorities say more than 1,100 inmates are currently serving time in cases in which Dookhan was the primary or secondary chemist.

Dookhan could face more than 20 years in prison if convicted. She is charged with two counts of obstruction of justice, a felony count that carries up to 10 years in prison, and pretending to hold a degree for a college or university, a misdemeanor punishable by as much as a year in jail.

The two obstruction charges accuse Dookhan of lying about drug samples she analyzed at the lab in March 2011 for a Suffolk County case, and for testifying under oath in August 2010 that she had a master's degree in chemistry from the University of Massachusetts, Attorney General Martha Coakley said at a news conference Friday.

The only motive authorities have found so far is that Dookhan wanted to be seen as a good worker, the state attorney general said.

"Her actions totally turned the system on its head," Coakley said. She said Dookhan could face more charges as the investigation continues. "People absolutely deserve a system they can trust. ... We have to get to the bottom of this, and we will," Coakley said.

Dookhan was taken to state police barracks in Foxborough to be booked before her scheduled arraignment in Boston Municipal Court on Friday afternoon.

It is unclear whether anyone else will face charges, but Dookhan's supervisors have faced harsh criticism for not removing her from lab duties after suspicions about her were first raised by her co-workers and for not alerting prosecutors and police. There is no indication so far of criminal activity by anyone else at the lab, Coakley said.

Co-workers began expressing concern about Dookhan's work habits several years ago, but her supervisors allowed her to continue working. Dookhan was the most productive chemist in the lab, routinely testing more than 500 samples a month, while others tested between 50 and 150.

One co-worker told state police he never saw Dookhan in front of a microscope. A lab employee saw Dookhan weighing drug samples without doing a balance check on her scale.

In 2010, a supervisor did an audit of Dookhan's paperwork but didn't retest any of her samples. The audit found nothing wrong.

The same year, a chemist found seven instances where Dookhan incorrectly identified a drug sample as a certain narcotic when it was something else. He told state police he told himself it was an honest mistake.

In an interview with state police late last month, Dookhan allegedly admitted faking test results for two to three years. She told police she identified some drug samples as narcotics simply by looking at them instead of testing them, a process known as "dry labbing." She also said she forged the initials of colleagues and deliberately turned a negative sample into a positive for narcotics a few times.

Defense attorneys for drug suspects were not surprised by Dookhan's arrest.

"I hate to say it ? it's more than appropriate," said attorney Bernie Grossberg, who has already had one client released from prison and has been deluged by calls from other clients since news of the scandal broke.

Attorney John T. Martin, who has a client who was allowed to withdraw his guilty plea based on concerns over Dookhan's work, said: "I think it's rather tragic ... that she finds herself in the same position as the people she was testifying against. I hope the system isn't treating the evidence against her the way she treated the evidence against several thousand defendants."

Dookhan was suspended from lab duties after getting caught forging a colleague's initials on paperwork in June 2011. She resigned in March as the Department of Public Health investigated. The lab was run by the department until July 1, when state police took over as part of a state budget directive.

Dookhan said she just wanted to get the work done and never meant to hurt anyone.

"I screwed up big-time," she is quoted as saying in a state police report. "I messed up bad; it's my fault. I don't want the lab to get in trouble."

Their settings are rural, urban, and suburban; and their heroes are a modest Westerner, an arrogant foreigner, and a gregarious East Coaster; but all are attempts to find a formula that can be entertainingly repeated 24 times a year. Two of them are successful. One can?t crack the case.

In Elementary (Thursdays at 10 p.m.), Jonny Lee Miller?s Sherlock Holmes is a recovering drug addict whose post-rehab regime has him working as a consulting detective in present-day New York. His stylish partner in crimesolving is Dr. Joan Watson (Lucy Liu), a former surgeon who now spends her days as a ?sober companion,? a line of work that Holmes charmingly likens to ?a glorified helper monkey.? None of these departures from the Conan Doyle canon bothers me in the slightest. A female Watson feels fresh and full of potential; Holmes? powers of deduction should work just as well on this side of the Atlantic; and Benedict Cumberbatch has no monopoly on 21st-century Holmesiness.

But that British version raises a red flag: The BBC has produced six episodes of Sherlock since 2010. Two, ?A Study in Pink? and ?A Scandal in Belgravia,? were superb. One, ?The Blind Banker,? was embarrassingly bad. And the other three, like the curate?s egg, were good in parts. If Britain?s finest TV writers can barely manage to stay above the Mendoza line, is there any hope that CBS scribes churning out two dozen episodes a year can consistently create Holmes-worthy logic puzzles?

Judging from the pilot, the answer is no. Miller and Liu are both captivating actors, and their damaged characters mesh together well, but the mystery?the show?s raison d??tre?is a disaster. Worst of all, it breaks the cardinal rule of the detective story, spelled out by P.D. James in her book Talking About Detective Fiction: The solution must be ?one which we the readers should be able to arrive at from evidence fairly presented.? Instead, Elementary?s first investigation depends on guesswork, coincidence, plot points that have been used so frequently they are now procedural clich?s, and the utterly unbelievable.

The first three of those sins are annoying, but the last is unforgivable. TV crime always requires a certain suspension of disbelief?suspects confess far too easily, DNA results appear in a flash?so I don?t care that Watson always finds street parking in Manhattan or that Holmes happens to find a decade-old case just like the one he?s currently investigating by flipping through files. But would an NYPD detective give a drug addict fresh out of ?junkie jail? unfettered access to his crime scene and interrogation room? By the mystery?s big reveal, a farce of technology that will make anyone who?s recently bought a cellphone scoff, I was near screaming with irritation.

There is nothing original about Made in Jersey (Fridays at 9 p.m.). Its setup?working-class Jersey girl shakes up snooty Manhattan law firm?is 20 percent My Cousin Vinny, 80 percent Legally Blonde. Let?s call it Legally Bayonned. But in the world of procedurals, a sturdy frame matters more than an original concept. Elementary is an architectural folly that can?t possibly stand up to the wear and tear of a season?s worth of cases; Made in Jersey on the other hand, is an unglamorous but solid split-level suburban that will have no problem passing inspection. In the opening episode, we meet ballsy new associate Martina Garretti (Janet Montgomery), the stuck-up lawyers and salt-of-the-earth paralegals she works with, and her chaotic-but-loving family over in the Garden State. Sherlock has his smartphone, but Martina?s army of human clue-droppers and intel sources are far more telegenic.

Subtlety isn?t among Made in Jersey?s attributes. The pilot?s first images are a suspension bridge and a subway tunnel, and in her red blazer and amazingly voluminous hair, Martina stands out from her sober-suited, sleek-coiffed colleagues at Stark & Rowan. She has much more in common with her clients than her co-workers, and that?s her biggest asset: She?s the plebe whisperer, able to explain the mysterious world of tight jeans and cheap hair dye to the children of privilege preparing the case for the defense.

The charming Vegas (Tuesdays at 10 p.m.) follows Ralph Lamb (Dennis Quaid, looking mid-century manly), a taciturn rancher, as he reluctantly tackles the task of cleaning up the crime that the new casinos are bringing to 1960 Las Vegas. He?s the charismatic, enigmatic force that every procedural needs at its center, but he?s got family and friends to help with his investigations, and in Michael Chiklis? casino owner Vincent Savino, an enemy worth his time and trouble. Vegas relies on viewers recognizing clues from the future?not just the physical evidence, like that sign proclaiming ?Nuclear Test Site,? but also in the social mores of an era when parents had more control over their kids? lives and men over their womenfolk.

For all their apparent dissimilarities, testosterone-tinged Vegas and estrogen-infused Made in Jersey are both classic, well-made legal procedurals centered around family. The heroes?a fourth-generation rancher and the last in a long line of beauticians?are slowly moving away from the trades that have been in their blood for generations. And both wear a star: Ralph clips a metal one to his vest, while Martina gets one tattooed on her hip.

Thanks to nice touches like that star, no matter how dogged, diligent, and creative Martina is, her co-workers will never see her as anything other than a cut-rate upstart with trashy relatives. ?Don?t worry,? one WASPy colleague tells her, ?You lower expectations just by walking in the room.? In that sense, Martina is just like a procedural. Underestimated and unappreciated, she works hard and makes it look easy. And it doesn?t matter what the snobs think, because real people will love her.

Researchers call for specialty metals recycling

ScienceDaily (Sep. 24, 2012) ? An international policy is needed for recycling scarce specialty metals that are critical in the production of consumer goods, according to Yale researchers in Science.

"A recycling rate of zero for specialty metals is alarming when we consider that their use is growing quickly," said co-author Barbara Reck, a research scientist at the Yale School of Forestry & Environmental Studies.

Specialty metals, which include rare earth elements such as indium, gallium and germanium, account for more than 30 of the 60 metals in the periodic table. Because they are used in small amounts for very precise technological purposes, such as red phosphors, high-strength magnets, thin-film solar cells and computer chips, recovery can be so technologically and economically challenging that the attempt is seldom made.

"Specialty metals are used in products in only small amounts, but their value typically does not provide enough incentive to invest in a complicated recovery process. Also, the technology to do so is untested," said Thomas Graedel, the study's other co-author and Clifton R. Musser Professor of Industrial Ecology.

The researchers said improved design for recycling, deposits on consumer goods, recycling targets for specialty metals and financial incentives for industry to apply state-of-the-art separation techniques and recycling technologies would improve metal recycling.

"Metals are infinitely recyclable in principle, but, in practice, recycling is often inefficient or essentially nonexistent because of limits imposed by social behavior, product design, recycling technologies and the thermodynamics of separation," said Reck.

The researchers said that modern technology has produced a conundrum. The more intricate the product and the more diverse the materials it uses, the better it's likely to perform but the more difficult it is to recycle.

The benefit to recycling metals, they said, includes the potential to reduce the extraction of virgin ores, thus extending the life of those resources. The environmental impacts of metal production are reduced substantially when recycled materials, rather than primary materials, are used, and recycling a metal is generally much more energy-efficient than acquiring it from a mine.

"Depending on the metal and the form of scrap, recycling can save as much as a factor of 10 or 20 in energy consumption," Graedel said. "The situation clearly calls for international policy initiatives to minimize the seemingly bizarre situation of spending large amounts of technology, time, energy and money to acquire scarce metals from the mines and then throwing them away after a single use."

Balancing food, weather, and population

Cyclical or secular? That?s the question economists, historians, climatologists, farmers, consumers ? just about anyone with an interest in the future, which is more or less everyone ? are trying to answer.

During bad times, the idea of cyclicality is encouraging. We can ride out hardship because prosperity is just around the corner ? although we also can?t relax when things are looking up because the economy is sure to head south again.

A secular change, on the other hand, means we?ve entered a new era, which is swell if that era is prosperous and plentiful ? the two-decade ?great moderation? that started in 1985, for instance. But secular change can also mean we get locked into sluggishness and scarcity as far as the eye can see. That?s the worry that has accompanied the Great Recession that began in 2007 and persists in many sectors of the world economy.

The drought that has gripped the agricultural heartland of the United States, Russia, Australia, India, and other food-producing regions of the world in 2012 (see this current Monitor cover story) has a cyclical/secular dimension. If the climate has changed, drought could be the new normal, with big implications for consumers, especially in poor countries. But parched conditions could also just be a bad patch of weather similar to the great droughts of the 1930s, early 1950s, and late 1980s. Tree-ring data indicate droughts even more severe than those in the 1930s occurred in pre-Columbian North America.

If that seems cyclical, there?s still a secular dimension. The 21st-century combination of global population and global trade, as Dan Murphy notes in this week?s cover story, is unprecedented. Never before have 7 billion people lived on this planet (with 2 billion more on the way by 2050). Never before have far-flung markets been so interconnected.

If droughts merely come and go, feeding the burgeoning world population would be difficult enough. If droughts are a more permanent condition now because the climate is growing warmer, feeding the world will require the best and brightest in agriculture and resource management.

You may not recall the drought of 1988. There was plenty of other news that year ? a US presidential election; the start of anticommunist revolutions in Eastern Europe; a devastating earthquake in Armenia; the explosion of Pan Am Flight 103 over Lockerbie, Scotland. But the ?88 drought at one point covered 45 percent of the US, and until hurricane Katrina it was the costliest natural disaster in US history. A study commissioned by Oxfam indicates that if an ?88-scale drought recurred in 2030, poorer countries that import corn and wheat would face a shock so severe that famine and social unrest would be the result.

A sharp rise in food prices in 2007-08 roiled populations from Mexico to Sri Lanka and helped set the stage for today?s Middle East upheaval. So far, the drought of 2012 has not caused panic, largely because governments from Egypt to India warehoused foodstuffs for just such a contingency.

Prudence is important even if Earth?s weather isn?t undergoing secular change. Rains come and go. Years of lean follow years of plenty. But feeding 9 billion people by midcentury is more than a cyclical challenge. It will require levels of innovation and co-operation never before seen in human history.

Nabbing the iPhone 5 Surprisingly Easy

NEW YORK CITY? Hearing that Apple?s new iPhone 5?s had sold out in less than an hour last week, aspiring upgraders may have concluded that getting the newsmartphone?today, or even this week, would be a nightmare. Dramatic news accounts of Apple fans sleeping out for days probably didn?t help, either.

But, as TechNewsDaily found after hitting the streets and?talking?to retailers, getting an iPhone 5 on day one hasn?t been so bad ? especially if you stayed away from Apple stores.

There are plenty more options beyond the roughly 250 Apple stores in the U.S. Other major retailers include Best Buy (with 1,400 locations), Wal-Mart (600), Radio Shack (4,600), and local AT&T (roughly 2,300) and Verizon stores (more than 2,000).Sprint did not reply in time for this article, but it issued a statement to the press that stock was running low on the East Coast.

In general, the number of people in line has been manageable. ?We?re averaging about thirty or so [at our stores],? said Brenda Rainey, a spokesperson for Verizon?Wireless, referring to the company?s stores all over the U.S. ?They are comfortable lines.?

That jibes with what TechNewsDaily found on the streets of Manhattan. This reporter crossed the street to a Verizon store on Fifth Ave. and 21st St. at about 8:45 a.m. At around 9:15, I walked out with a white, 32 GB model. And whites are rare. Even at Apple stores, conditions were tolerable. At the iconic glass-cube branch on Fifth Ave. and 58th St., some fans had been ?occupying? the marble plaza for several days. But most of the roughly 500 to 1,000 people had arrived that morning ? albeit as early as 3:00 a.m. ? in anticipation of the 8:00 a.m. opening.?And Apple moved them through quickly. A colleague entered the store about 10:30 AM and left 40 minutes later with a black 16GB model for the AT&T Network.

The line was also mild at Grand Central Station ? yes, Grand Central. To keep from clogging up the busy main hall, Apple shunted customers off to a line of perhaps 100 to 200 people in a side hallway.

Turnover at top of IRS as tough 2013 tax season nears

WASHINGTON (Reuters) - The chief of the Internal Revenue Service will step down soon and, with no successor in sight, the IRS is likely to head into a difficult 2013 tax-filing season led by an interim boss.

That is not an ideal situation, said tax lawyers. But they gave generally high marks to the IRS official they expect to be named as the temporary head of the U.S. tax agency come mid-November.

That is when IRS Commissioner Doug Shulman's term in office will end. He plans to leave at that time as head of the 104,000-employee agency, according to an IRS spokesperson.

The Obama administration will probably then appoint Steven Miller as acting commissioner, the tax lawyers said.

Miller currently serves as IRS deputy commissioner for services and enforcement. Deputies have filled in as IRS commissioner in the past when no permanent replacement was promptly nominated by the president and confirmed by the Senate.

Miller, who has spent more than 20 years at the IRS, has been a deputy commissioner since September 2009. He previously headed the IRS's exempt organizations division. He also worked at the congressional Joint Committee on Taxation.

"The next year or two will be a particularly challenging period for the IRS," said former IRS Commissioner Mark Everson, now vice chairman of alliantgroup LP, a tax consultancy for small businesses.

"It would be best to have a nominated and confirmed commissioner who has standing within the administration and with the Congress," Everson added.

Former IRS Commissioner Fred Goldberg, a partner at law firm Skadden Arps Slate Meagher & Flom LLP, said, "Steve Miller is eminently qualified to take over on an acting basis."

Miller did not respond to requests for comment.

The Treasury Department, which oversees the IRS, declined to comment about potential successors to Shulman, a Democrat appointed to the post under Republican President George W. Bush.

The 2013 tax-filing season is going to be complicated by the "fiscal cliff" facing Congress. At the end of the year, unless lawmakers act very soon, ordinary income and investment income tax rates will go up because deep cuts made under Bush and extended by President Barack Obama will expire.

At the same time, Congress has failed to deal with a host of other urgent tax issues such as extending temporary tax provisions and constraining the Alternative Minimum Tax.

HEALTHCARE LAW

Shulman has focused on fighting offshore tax evasion and starting a program to make tax return preparers better trained and more accountable, among other initiatives.

His legacy may be decided by Obama's 2010 healthcare law, according to Ken Kies, a Republican tax lobbyist. The IRS will play a key role in the law, including a new tax for individuals who fail to obtain medical insurance starting in 2014.

The law is considered Obama's signature domestic policy achievement. It was passed by Congress despite unified opposition from Republicans. Shulman has defended the law before Republican lawmakers.

The naming of a permanent replacement for Shulman will hinge on the outcome of the November 6 presidential election between Obama and Republican challenger Mitt Romney.

Americans normally must file their tax returns by April 15 each year. That is less than seven months away. Many major tax questions remain unanswered, with the IRS under growing pressure to print tax return forms, train and assign staff and keep taxpayers informed about what is happening with tax law.

Before Shulman was confirmed by the Senate in March 2008, the IRS was led by two acting commissioners over a transition period of more than nine months. The previous Senate-confirmed commissioner was Everson, who stepped down in May 2007.
